A bail bond is a legally binding agreement that allows a defendant to be released from jail while they await trial. Here's exactly how it works:
The court sets a bail amount based on the charges, the defendant's criminal history, flight risk, and public safety considerations.
You pay 10% to Bob Barry Bail Bonds this is the non-refundable premium set by Florida law. On a $10,000 bail, you pay $1,000.
We post the full bail amount to the court on the defendant's behalf, guaranteeing their appearance at all required court dates.
The defendant is released and must comply with all conditions set by the judge until their case concludes.

In Florida, the bail bond process follows a set sequence from arrest to release. Here's what happens at each stage -- and where Bob Barry Bail Bonds steps in to help.
Step 1 - Arrest and Booking- After an arrest, the defendant is taken to jail for processing. This includes photographing, fingerprinting, and recording the charges. Step 2 - First Appearance / Magistrate Hearing - Within 24 hours of arrest for a misdemeanor or felony in Florida, the defendant must be brought before a judge for a first appearance hearing. The judge reviews the charges and sets the conditions for release, including the bail amount. The judge considers:
* Severity of the charges -- more serious crimes result in higher bail or no bail
* Criminal history -- prior arrests or failures to appear in court
* Flight risk -- community ties, employment, and likelihood of appearing at future hearings
* Public safety -- whether releasing the defendant poses a risk to others
If the defendant is already on probation or has an immigration hold, the judge may order them held without bail.
Step 3 - Contacting a Bail Bond Agent- Once bail is set, the defendant or their family contacts Bob Barry Bail Bonds. You pay 10% of the total bail amount as our non-refundable fee. We cover the remaining 90% and post the full bond to the court.
The entire process can be handled by phone - payment and paperwork completed remotely via DocuSign. You do not need to come to our office.
Step 4 - Release from Jail– Once the bond is posted, the jail processes the release. At the Volusia County Branch Jail, release typically takes 2 to 6 hours depending on processing workload. The defendant is released with conditions set by the judge - including attending all future court dates.
